This document outlines the rules, terms and conditions related to the consignment of artworks between UnikArt (The Gallery) and the Artist. These consignment terms & conditions are to be treated in full confidentiality.
The artist hereby authorises and appoints UnikArt (the gallery) to list, store, exhibit, promote, sell and deliver the artworks consigned under the agreement. The gallery shall not permit the artworks to be used for any other purposes without prior approval by the artist (Written Consent, E-mail or WhatsApp).
The Artist agrees to consign to the gallery and the gallery (UnikArt) hereby accepts on consignment; the artwork(s) submitted for the whole duration of this agreement or the consignment until terminated by either party.
The Artist hereby certifies and warrants that he or she created and possesses the full copyrights to the artwork and that their descriptions are true and accurate.
Artists should ensure the consigned artworks are fit to be displayed securely and any relevant ways to display or care for the artwork if any, must be provided by the artist. It is also recommended that artists suggest any ways in which their relevant artwork should be stored or packaged to prevent loss or damage. The gallery usually uses bubble wrap, stretch film or kraft paper to package artworks for delivery.
Upon agreeing to consign artworks to UnikArt, the artists also agree to provide an asking price along as any relevant discounts (% rate or discounted asking price) applicable, whenever he/she submits an artwork to the gallery.
Payment to the artist is made within 10 to 15 days, via bank transfer or cash, after the consigned artwork is sold and delivered to the relevant buyer. Amount payable to artists will include any deductions based on above-mentioned rates or commissions or as agreed between the artist and gallery.
The artist grants the gallery permission to use photos/videos and any relevant details associated to the consigned artworks for promotional purposes including but not limited to websites, social media, newsletters, blog posts and any form of print advertising. This does not constitute as permission for the gallery to issue prints of the artwork for sale.
Bulky & Heavy items are classified as any artwork exceeding: 120cm x 100cm x 10cm (Width X Height X Depth) and/or any item irrespective of size which exceeds 25kg.
It is the artist’s responsibility to ensure delivery or pick-up of their artworks to and from the gallery unless otherwise agreed between the artist and the gallery.
Whilst extra-steps are taken in ensuring the safekeeping of the consigned artworks, the gallery shall not be held responsible for any loss or damage that may occur due to circumstances beyond the control of the gallery (This includes but is not limited to natural disasters, theft, or any other type of accidents/incidents).
The gallery shall under no circumstances remove, lend, or display the consigned artworks elsewhere other than the premises of UnikArt or its storage facility, without prior approval of the artist. The gallery may from time to time temporarily exhibit the consigned artworks at other locations and is responsible to inform the artist of any such opportunities.
An artwork consigned to the gallery will only be listed for sale on our website subject to meeting all of the above terms and after the submission of the relevant details of that particular artwork including but not limited to artwork title, medium, description and price.
This agreement may also be amended or terminated as required by the artist or gallery upon written notice to each other. In cases of death or the business ceasing to exist, the artworks or proceeds shall be returned to the artist or its successors upon production of supporting evidence.
Valid as of: 24 March 2023
This agreement and the terms associated to it are governed by the laws in force in Mauritius. If any part of this agreement and its corresponding terms is deemed to be illegal, void, or unenforceable; the document shall be considered invalid. A waiver of any breach of this agreement does not construe to a continuing waiver of the other provisions in this agreement or the terms associated to it.
