CONSIGNMENT TERMS & CONDITIONS

This document outlines the terms and conditions governing the consignment of artworks between UnikArt ("The Gallery") and the Artist. By submitting an artwork on consignment, the Artist authorises and appoints UnikArt to list, store, exhibit, promote, sell, and deliver their consigned artworks as per this agreement.
1. CONSIGNMENT
- The Artist consigns their artwork to UnikArt, and UnikArt accepts it under the terms of this agreement.
- The Gallery shall not use the artworks for any purposes outside the scope of this agreement without prior written consent from the Artist (via email, WhatsApp, or written notice).
2. COPYRIGHT & EXCLUSIVITY
- The Artist certifies that the consigned artwork(s) are their original creations, that they hold full copyright to the artwork(s), and that all provided descriptions are true and accurate.
- The Artist agrees not to list, exhibit, or sell the same artwork through another gallery, platform, or marketplace while it is consigned to UnikArt unless otherwise agreed in writing.
3. ARTWORK INFORMATION
The Artist must provide complete and accurate details for each consigned artwork, including but not limited to the title, description, materials, medium, dimensions, and year of creation. This information is essential for proper representation and sale.
4. PRICING & COMMISSION
- Listing artworks on UnikArt is free.
- The Artist must provide an asking price and any applicable discounts when submitting an artwork for sale at UnikArt.
- A variable administrative fee of up to a maximum of Rs 1,000 is added to the asking price to determine the final price displayed on our website.
- A fixed 10% commission is deducted from the Artist’s asking price only if the artwork is sold.
5. PAYMENT TO ARTIST
Payments to the Artist are made within 10 to 15 days after the artwork is sold and delivered. Payment is made via bank transfer or cash. The amount payable to the artist will be as per pricing rules above.
6. ARTWORK DROP-OFF & PICK-UP
The Artist is responsible for the drop-off and pick-up of consigned artwork unless otherwise agreed with the UnikArt.
7. DELIVERY OF SOLD ARTWORKS
UnikArt provides free delivery of sold artworks except for large, heavy, bulky, and fragile items as detailed below:
- Large items exceeding 150cm on one side and 120cm on the other.
- Heavy Items exceeding 25 kg in weight
- Bulky items that are difficult to handle
- Fragile objects requiring custom transport solutions
Delivery charges for any such item as listed above will be at the expense of the customer and not the artist unless stated otherwise.
8. DISPLAY, STORAGE & CARE
The Artist must inform UnikArt of any specific display, storage, or care instructions for their artwork. The Artist is encouraged to provide packaging recommendations to minimize the risk of damage during delivery. The Gallery typically uses bubble wrap, stretch film, or kraft paper for packaging.
9. PROMOTION & REPRODUCTION RIGHTS
- The Artist grants the Gallery permission to use photos, videos, and relevant details of consigned artworks for promotional purposes, including but not limited to websites, social media, newsletters, blog posts, and print advertising.
- UnikArt will not modify or alter the artwork’s images except for standard resizing, or formatting adjustments.
- This permission does not include the right to reproduce or sell prints of the artwork.
10. REMOVAL FOR EXHIBITIONS & TEMPORARY VENUES
UnikArt will not remove, lend, or display consigned artworks outside its premises or storage facility without prior approval from the Artist. However, UnikArt may temporarily exhibit consigned artworks at selected locations and will notify the Artist of such opportunities.
11. LOSS & DAMAGE
While UnikArt takes reasonable care to protect consigned artworks, it is not liable for loss or damage due to natural disasters, theft, unforeseen accidents, or natural deterioration over time, including patina, fading, or material aging.
12. LISTING APPROVAL & QUALITY CONTROL
An artwork will only be listed for sale on UnikArt’s website after the Artist has provided all required details, including the title, medium, description, and price. The Gallery reserves the right to decline any artwork that does not meet originality, pricing or presentation standards.
13. TERMINATION
This agreement may be amended or terminated by either party upon written notice. If UnikArt ceases operations, all consigned artworks will be returned to the Artist. In the event of the Artist’s passing, consigned artworks or proceeds will be transferred to the Artist’s successors upon verification of supporting evidence.
