This agreement outlines the terms and conditions governing the consignment of artworks between UnikArt (“The Gallery”) and the Artist.
By registering for an Artist Account on our website or submitting an artwork on consignment, the Artist authorises UnikArt to list, store, exhibit, promote, sell, and deliver their artworks under this agreement.
ELIGIBILITY & SUBMISSION
- The Artist should be 18 years old and a Mauritian or resident of Mauritius. Artists under 18 years of age require parental or legal guardian consent.
- Only original & unique (one-of-a-kind) artworks created by an artist are accepted.
- Accepted types of art include but are not limited to paintings, mixed media, drawings, sketches, sculptures, installations, photographs, and digital art. Terms for photographs and digital art vary per submission.
- All approved (registered) Artists must submit artworks online via their account on the website.
ARTWORK INFORMATION, COPYRIGHT & EXCLUSIVITY
- The Artist should provide as much information and details about their artwork upon submission, including title, description, style, materials, medium, dimensions, and year of creation.
- The Artist certifies that the consigned artwork(s) are their original creations, that they hold full copyright to the artwork(s), and that all provided descriptions are true to the best of their knowledge and reflect their own artistic perspective.
- The Artist agrees not to list, exhibit, or sell the same artwork through another gallery, platform, or marketplace while it is consigned to UnikArt unless otherwise agreed in writing.
PRICING & COMMISSION
- Listing & submitting artworks are completely free at UnikArt.
- The Artist must provide an asking price and any relevant discounts that may be applicable for each submission.
- A 10% commission is deducted from the asking price only if the artwork is sold.
- A variable Administrative Fee of up to Rs 1,000 is added to the asking price to determine the Displayed Selling Price on the website, excluding oversized, bulky, heavy, or fragile items.
- For oversized, bulky, heavy, or fragile items, additional charges for logistics, including delivery and packaging, will be factored into the Displayed Selling Price.
Selling Price = Asking Price + Admin Fee + Any Additional Charges (if Oversized, Bulky, Heavy or Fragile)
OVERSIZED, BULKY, HEAVY & FRAGILE ARTWORKS
UnikArt classifies oversized, bulky, heavy & fragile items as follows:
- Oversized or Large: Artworks exceeding 120cm on one side and 100cm on the other.
- Bulky: Artworks that are difficult to handle and transport
- Heavy: Artworks exceeding 30 kg in weight including packaging
- Fragile & Delicate: Artworks that may be easily damaged
CONSIGNMENT DURATION, DROP-OFF & PICK-UP
- The consignment duration starts at a minimum of three months, with the option for longer periods.
- It is the responsibility of the artist to drop-off/pick-up their artwork to & from UnikArt, unless otherwise agreed.
DELIVERY OF SOLD ARTWORKS
- UnikArt provides customers with free delivery within 3 to 5 working days.
- Items classed as Oversized, Bulky, Heavy & Fragile may take additional time.
PAYMENT TO ARTISTS
- Payments to artists are made 10 to 15 working days after their artwork has been delivered to the customer.
- All payments to artists are carried out by bank transfer or cash as preferred by the artist.
- Payment amounts will vary depending on the price at which the artwork is sold and be caculated as follows:
- If artwork is sold at normal Selling Price (Displayed Price), the payment amount will be calculated as follows: Payment Amount = Asking Price - (10% of Asking Price)
- If artwork is sold with discount, the guaranteed minimum payment amount will be calculated as follows: Minimum Payment Amount = Minimum Asking Price - (10 % of Minimum Asking Price)
ARTWORK DISPLAY, STORAGE & CARE
- The Artist must inform UnikArt of any specific display, storage, or care instructions for their artwork.
- Any special Packaging & wrapping preferences should be communicated to UnikArt.
- UnikArt makes use of a combination of bubble wrap, stretch film, or kraft paper for packaging
PROMOTION & REPRODUCTION RIGHTS
- The Artists grants the Gallery permission to take and use photos, videos and relevant details of consigned artworks for promotional and illustrative purposes including but not limited to websites, social media, newsletters, and any form of advertising.
- This permission does not include the right to reproduce or sell copies or prints of the artwork.
EXHIBITIONS & PUBLIC DISPLAY
- The gallery will not remove, lend, or display consigned artworks outside its premises or storage facilities without prior approval from the Artist.
- UnikArt may temporarily exhibit consigned artworks at selected locations and will notify the Artist of such opportunities.
ACCIDENTAL LOSS & DAMAGE
While UnikArt takes reasonable care to protect consigned artworks, it is not liable for loss or damage due to natural disasters, theft, unforeseen accidents, or natural deterioration over time, including patina, fading, or material aging.
APPROVAL & REJECTION
- An artwork will only be listed for sale if it meets the requirements of this consignment agreement
- UnikArt reserves the right to decline or reject any requests for an Artist Account or submissions that do not meet originality, pricing & presentation standards.
CHANGES & ACCEPTANCE OF TERMS
- UnikArt may alter, modify or change these consignment terms at any time without prior notice.
- The latest and updated consignment terms are available before submitting a new artwork or on the My-Account page for an Artist Account.
- Continued use of our consignment service to list artworks would be deemed as acceptance of our consignment terms in whole.
TERMINATION & SUCCESSION
- This agreement may be terminated by either party via email, WhatsApp, or written notice.
- In case UnikArt ceases operations, all unsold artworks will be returned to their respective artists.
- In the event of an artist passing away, unless otherwise agreed, their unsold artworks or proceeds from sales will be tranferred to their legal successors or heirs upon presentation of valid documentation.
